FH Resmikan Kelompok Studi Hukum Ekonomi Syariah

Fakultas Hukum Universitas Negeri Semarang (FH Unnes) meresmikan Kelompok Studi Hukum Ekonomi Syariah bersamaan dengan sosialisasi asuransi syariah, di Hotel Grasia, Jumat (11/3). Acara sosialisasi tersebut merupakan hasil kerja sama FH Unnes dengan Otoritas Jasa Keuangan (OJK).

Wakil Rektor Bidang II Dr S Martono menyatakan, kelompok studi bakal melakukan kajian sekaligus memberi masukan kepada pelaksanaan asuransi syariah yang izin operasionalnya yang didasarkan pada Keputusan Menteri Keuangan RI No 426/KMK.06/2003 itu. Kajian ilmiah terkait kelembagaan keuangan oleh perguruan tinggi juga dibutuhkan supaya semakin banyak kalangan tak ragu untuk bergabung.

Direktur Industri Keuangan Non-Bank Syariah OJK, Moch Muchlasin, menyatakan keberadaan asuransi syariah belum banyak diketahui oleh masyarakat luas. Otoritas Jasa Keuangan (OJK) menggandeng berbagai pihak, termasuk perguruan tinggi, untuk turut menyosialisasikan keberadaan asuransi ini.

Ia menjelaskan, hingga saat ini jumlah konsumen asuransi ini baru mencapai 5,3 persen dibanding dengan asuransi konvensional. Oleh sebab itu, ia mengatakan OJK telah merancang program sosialisasi untuk mengenalkannya kepada masyarakat.

”Untuk asuransi syariah kami targetkan dalam lima tahun ke depan meningkat menjadi dua kali lipat, atau setidaknya 10 persen,” kata dia.

Muchlasin menyadari asuransi syariah belumlah akrab di telinga masyarakat. Selama ini, menurut dia, sistem keuangan model syariah masih identik dengan bank syariah. Ia membandingkan dengan Malaysia yang telah lebih dulu mengenal sehingga asuransi ini lebih dominan menguasai ketimbang asuransi konvensional. ”Di Malaysia sudah mencapai 20 persen,” kata dia.

Dosen Unnes Dr Duhita Driyah Suprapti mengatakan prinsip asuransi dalam Islam adalah saling bertanggung jawab, saling bekerja sama untuk membantu, dan saling melindungi dari segala kesusahan. Sedangkan landasan hukum positifnya adalah konstitusi, undang-undang, peraturan pemerintah, dan peraturan menteri.

Ia mengatakan, keunggulan asuransi syariah, di samping memberikan manfaat proteksi, juga punya manfaat sosial serta bernilai ibadah. ”Asuransi syariah memastikan dana yang disetorkan nasabah berupa dana tabarru, dana investasi, serta ujrah (dana operasional), dipisahkan dalam akun-akun yang berbeda selaras dengan prinsip-prinsip syariah yang adil dan menentramkan,” kata dia.

Selain itu, asuransi syariah juga terbebas dari aktivitas riba dan risiko penipuan atau hal-hal yang merugikan nasabah. Hal itu karena transaksi dan pengelolaan dana berada di bawah pengawasan Dewan Pengawas Syariah berdasarkan arahan Dewan Syariah Nasional Majelis Ulama Indonesia (MUI). Karena itu, kompetisi antarperusahaan asuransi syariah pun nampak makin kompetitif.
