Banyaknya Sertifikat Tanah Ganda, Mahasiswa FH UNNES Teliti Dampak Program PTSL

Sebagai wujud kepedulian terhadap permasalahan hukum agraria dan dalam rangka penyusunan tugas akhir, Adelia Nada Hapsari, mahasiswa Fakultas Hukum Universitas Negeri Semarang (UNNES), melakukan penelitian tentang implementasi Program Pendaftaran Tanah Sistematis Lengkap (PTSL) di Kabupaten Sukoharjo.

Penelitian yang dimulai sejak Januari 2025 ini mengangkat judul “Analisis Implementasi Pendaftaran Tanah Sistematis Lengkap (PTSL) dalam Mewujudkan Legalisasi Penguasaan Tanah di Kabupaten Sukoharjo”. Adelia berhasil mempertahankan hasil penelitiannya di hadapan dosen penguji, yaitu Dr. Suhadi, S.H., M.H., dan Aprila Niravita, S.H., M.H., serta dibimbing oleh Dr. Asmarani Ramli, S.H., M.Kn.

Latar belakang penelitian ini berangkat dari permasalahan yang kerap muncul di masyarakat, yaitu sertifikat tanah ganda yang menyebabkan ketidakpastian hukum, konflik agraria, dan menurunnya kepercayaan publik terhadap sistem pertanahan. Permasalahan ini umumnya dipicu oleh lemahnya sistem administrasi, minimnya pengawasan, serta ketidakakuratan data di Badan Pertanahan Nasional (BPN).

Melalui penelitian yang difokuskan di Kabupaten Sukoharjo, Adelia menemukan bahwa program PTSL yang dilaksanakan di wilayah tersebut telah memberikan dampak positif. Program ini dilaksanakan berdasarkan Peraturan Menteri ATR/BPN Nomor 1 Tahun 2017, dengan tujuan untuk memastikan keabsahan data fisik maupun yuridis atas kepemilikan tanah secara menyeluruh di tingkat desa.

Menurut Diar Rudyanto, S.E., M.M., selaku Kepala Kelompok Seksi Umum dan Kepegawaian, pelaksanaan program PTSL di Kabupaten Sukoharjo berjalan dengan menerapkan prinsip keadilan prosedural, berlangsung transparan, dan dapat dipertanggungjawabkan. Proses PTSL terdiri atas beberapa tahapan mulai dari alokasi anggaran, penyuluhan kepada masyarakat, pembentukan panitia desa, pengukuran, pemberkasan, hingga penerbitan dan penyerahan sertifikat.

Data menunjukkan bahwa pelaksanaan program PTSL di Kabupaten Sukoharjo mampu menurunkan jumlah sengketa tanah secara signifikan. Jika pada tahun 2016 terdapat 21 sengketa tanah, maka pada tahun 2024 jumlah tersebut turun menjadi hanya 6 kasus. Selain menurunkan sengketa, program ini juga memberikan dampak positif dalam mempermudah proses alih waris, meningkatkan kepastian hukum, serta memperkuat status kepemilikan lahan masyarakat.

Melalui penelitian ini, UNNES terus berkomitmen mendukung implementasi Tujuan Pembangunan Berkelanjutan (SDGs), khususnya pada poin ke-16 mengenai perdamaian, keadilan, dan kelembagaan yang tangguh. Kolaborasi antara pemerintah, aparat desa, dan masyarakat menjadi kunci untuk menciptakan tata kelola pertanahan yang adil dan transparan.
