Hukum progresif itu merupakan pilar pencapaian keadilan yang substansi yang mengutamakan pada kemaslakatan hidup manusia. Oleh karena itu, semua oleh pelaku hukum yakni penegak hukum maupun para akademisi hukum pada pendidikan tinggi hukum harus mempunyai karakter spirit dan jiwa-jiwa hukum progresif.

Sehingga hukum benar-benar menjadi sesuatu yang bermanfaat bagi tidak hanya manusia tapi makluk hidup.

Dekan Fakultas Hukum Universitas Negeri Semarang (Unnes) Dr Rodiyah SPd SH Msi menyampaikan itu saat Seminar Nasional dan Bedah Buku “Masa Depan Hukum Progresif” karya Prof Dr Suteksi SH MHum dosen Undip, Selasa (27/4) di hotel Patra Jasa Semarang.

Selain Dr Rodiyah, buku “Masa Depan Hukum Progresif” juga dibedah oleh Faisal SH MH.

Kegiatan diselenggarakan Program Studi Magister Ilmu Hukum, bagian Hukum dan Masyarakat Fakultas Hukum Undip bekerjasama dengan Magister Ilmu Hukum Fakultas Hukum Unnes diikuti ratusan orang dari mahasiswa S1, mahasiswa S2, dosen, kejaksaan, kehakiman, Polda Jawa Tengah, dan pemerhati hukum.

Dr Rodiyah juga mengemukakan, di hukum progresif itu sumbernya yakni keadilan yang mensejahterakan berdasarkan ketuhanan Yang Maha Esa.
“Perbedaan persepsi itulah yang kemudian memakmai legalitas hukum antara polisi, jaksa, lalu hakim yang memberi putusan itu bisa berbeda,” kata Dr Rodiyah.

Menurut Dr Rodiyah, hukum progresif ini harus kita dorong untuk menjadi roh atau jiwa pelaksanaan hukum di Indonesia, supaya penegak hukum dari tahapan petama (polisi), tahap kedua (jaksa), dan tahap ketiga (hakim) mempunyai persepsi yang sama bahwa sesungguhnya hukum itu tidak terbelenggu atau terjebak pada hukum positif.

Artinya jikalau hukum positif itu adalah benar benar tidak memberikan keadilan maka seorang penegak hukum harus melakukan rule breaking atau penegakan hukum tidak berdasarkan pada legalitas, tapi pencapaian tujuan keadilan substansi itu terwujud, jelasnya.

    Harapannya, para aparat penegak hukum dapat menerapkan hukum progresif dengan tetap mendasarkan diri pada nilai-nilai Pancasila dalam melaksanakan tugasnya sehingga dapat mewujudkan keadilan di tengah-tengah masyarakat.

  2. Potret hukum di Indonesia memang kadang terlihat ‘tidak adil’. Ada pepatah mengatakan, “Tumpul ke atas dan tajam ke bawah’. Hal ini sangat kentara terlihat tentang bagaimana hukum memperlakukan orang yang berkuasa ‘punya materi” dengan orang yang untuk makan saja sudah susah. Miris. Rasanya hati teriris.

    Hukum di Indonesia harus terus berbenah, agar masyarakat tidak lagi ‘pesimis’ dengan penegakan hukum yang adil di Indonesia ini.
