Penegakan hukum dijalankan seolah-olah hanya berdasarkan yang tertulis dalam undang-undang. Akibatnya, sering muncul ketidakadilan bagi masyarakat marginal.

Hal itu ditandaskan Rasdi, ketua panitia Seminar Internasional “Critical Approaches Toward Social Control”, Sabtu (1/9), di gedung H kampus Sekaran. Seminar diselenggarakan Fakultas Hukum (FH) Universitas Negeri Semarang (Unnes).

Kritik masyarakat hendaknya direspons, bukan hanya hukum yang tertulis di undang-undang, melainkan hendaknya diterapkan pada ruang dan waktu yang tepat. “Hukum di Indonesia ibarat mata pisau, tajam di bawah bagi kaum marginal namun tumpul bagi kaum atas atau konglomerat,” katanya.

Seminar tersebut merupakan salah satu upaya rekonstruksi wacana pembangunan opini publik di dunia mengenai penegakan hukum. Seminar dibuka oleh Pembantu Rektor III Unnes Prof Masrukhi.

Tukar Pikiran

Dalam seminar tersebut, praktisi hukum Fiammetta Bonfigli dari University of Milan Italia menjadi pembicara berdampingan dengan Rodliyah dan Indah Sri Utari, keduanya dosen FH Unnes. Seminar ajang tukar pikiran atas permasalahan dalam penegakan hukum di Italia yang hampir sama dengan Indonesia.

Fiammeta mengemukakan, penegak hukum  tengah menjadi sorotan banyak pihak di mana pun, sehingga kritik diharapkan menjadi kontrol sosial bagi para penegak hukum.

Dikemukakan pula, pemerintah memiliki dominasi hukum yang terlalu tinggi bagi masyarakat marginal. “Padahal, masyarakat marginal sebenarnya memiliki aturan sendiri yang lebih cocok dan sesuai dengan lingkungan mereka. Hanya, mereka belum memiliki kepastian hukum. Tidak semua kaum marginal mengetahui yang sebenarnya mereka lakukan.”

Pada bagian lain, Rodiyah mengemukakan, kasus pidana sering kali menyeret masyarakat kecil. “Contohnya pencurian sandal yang dilakukan anak dan pencurian beberapa buah kakao oleh Minah,” kata Rodliyah yang juga dosen luar biasa Akademi Kepolisian (Akpol) Semarang.

Seminar diwarnai beberapa pertanyaan dan sanggahan para peserta yang terdiri atas praktisi hukum dan mahasiswa dari sejumlah fakultas hukum di kota Semarang serta taruna Akpol.
